Digital Gift Card — Terms & Conditions

About these terms

  1. These terms and conditions ("Terms") apply to all digital gift cards ("Gift Cards") for Bar Gabi.

  2. Gift Cards are issued by JL & GR Hospitality Pty Ltd (ABN 81 698 451 455, ACN 698 451 455) trading as Bar Gabi, 21 Anderson Street, Yarraville VIC 3013 ("we", "us", "Bar Gabi").

  3. By purchasing, receiving or using a Gift Card, the purchaser and the recipient agree to these Terms.

2. Where you can use it

  1. Gift Cards can only be redeemed at Bar Gabi, 21 Anderson Street, Yarraville VIC 3013. They cannot be used at any other venue, including Restaurant Navi.

  2. Gift Cards can be used towards food and drinks purchased at Bar Gabi. Gift Cards cannot be used to purchase other Gift Cards.

3. Expiry

  1. Each Gift Card is valid for 3 years from the date of purchase. The expiry date is shown on the Gift Card (or in the email delivering it).

  2. Any balance remaining after the expiry date will be forfeited and cannot be refunded, extended or redeemed.

4. Using your Gift Card

  1. Please present your Gift Card (on your phone or printed) when you ask for the bill. We may need to scan or enter the code before payment.

  2. Gift Cards can be used across more than one visit until the balance is used up or the card expires. Any unused balance stays on the card.

  3. If your bill is more than the Gift Card balance, the difference must be paid by another accepted payment method.

  4. Gift Cards cannot be exchanged or redeemed for cash, and no change will be given.

  5. Gift Cards can be used to purchase alcohol only by persons aged 18 or over. Bar Gabi staff may ask for proof of age and will serve alcohol in accordance with responsible service of alcohol laws and our liquor licence.

  6. Gift Card values are in Australian dollars and include GST. A tax invoice is issued when the Gift Card is redeemed against goods, not at the time the Gift Card is purchased.

6. Lost, stolen or misdirected Gift Cards

  1. Please treat your Gift Card code like cash. Anyone who presents a valid code may redeem it.

  2. We are not responsible for lost, stolen or misused Gift Card codes, or for Gift Cards sent to an incorrect email address entered by the purchaser.

  3. If you lose your Gift Card email, contact us with proof of purchase and we will try to resend or reissue it for any unused balance, where we are able to verify it. A reissued card keeps the original expiry date.

7. Refunds

  1. Gift Cards cannot be refunded or returned for change of mind once purchased.

  2. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.

8. Promotional Gift Cards

  1. Gift Cards or vouchers issued free of charge, as part of a promotion, competition, donation or discount offer (for example "$100 value for $80") may have different terms and expiry dates, which will be shown on that card or offer. Where those specific terms differ from these Terms, the specific terms apply to the extent permitted by law.

9. Fraud and misuse

  1. We may refuse to accept, or may cancel, a Gift Card that we reasonably believe has been obtained fraudulently, altered, duplicated or resold without our authority.

10. Privacy

  1. We collect the purchaser's and recipient's names and email addresses only to issue, deliver and administer Gift Cards.

11. Changes to these Terms

  1. We may update these Terms from time to time. Any change will not reduce the expiry period or the value of a Gift Card purchased before the change.

12. General

  1. These Terms are governed by the laws of Victoria, Australia.
